Andrew Melnick filed the lawsuit against Betfair Interactive US, LLC who is operating as FanDuel Sportsbook. The complaint came following Melnick participating in live in-game betting on NCAA Men's Basketball matches.
The issue arose with Melnick wagering on Over/Under totals during college basketball betting. Melnick alleges that the times listed on the sportsbook were inaccurate to the actual time left in the games. This prevented Melnick from making a fair wager.

On February 28, 2021, Andrew Melnick logged on the FanDuel platform through Betfair to place wagers on NCAA college basketball games according to the lawsuit. Melnick was wagering on Over/Under, mainly focusing on game totals.
Melnick began wagering after the games were underway with live in-game betting, but discovered afterward that the amount of time left in the games and the current scores were inaccurate on the app itself. This led to his wagers coming up as losses where if he had accurate numbers he could have bet differently.
The plaintiff allegedly reached out the FanDuel's customer service in an attempt to get a refund but was denied one. This is what ultimately led to the lawsuit being filed.
Melnick and representatives are now looking to find others in the Colorado, Illinois, Indiana, Iowa, Michigan, New Jersey, Pennsylvania, Tennessee, Virginia, and West Virginia areas, where FanDuel operates, who have had similar issues with the sportsbook.
According to the lawsuit, FanDuel has a history of understating the time remaining in live sporting events, alleging that the sportsbook is wrong between 5% and 35% of the time.
Melnick believes this makes it hard for legal sports betting fans to have confidence in their wagers since they are betting on false information.
The lawsuit has recently been filed, and no statement has been made from FanDuel or Betfair as of the time of reporting.
